Fully Licensed for Hemp & CBD Manufacturing in Texas

The hemp and CBD market is changing fast. In 2026 alone, Texas rewrote the rules for manufacturing consumable hemp products, and Congress moved to narrow the federal definition of hemp. For brands, that means fewer manufacturing partners who can legally make your products — and a lot more questions.

What Changed in Texas

New rules from the Texas Department of State Health Services (DSHS) took effect on March 31, 2026. The headline change is cost: the license to manufacture consumable hemp products went from $258 to $10,000 per facility, every year. Retail registration went from $155 to $5,000 per location.

The rules also raise the bar on compliance:

  • THCA now counts toward total THC. Products are measured on total delta-9 THC, including converted THCA, against the 0.3% limit.

  • Two rounds of testing. Hemp is tested before processing, and finished products or ingredients are tested again before sale, each with a certificate of analysis.

  • 21+ sales only. Retailers must check a government-issued ID before every sale.

What’s Happening Federally

In late 2025, Congress narrowed the federal definition of hemp, limiting legal hemp products to 0.4 milligrams of total THC per container. The change was set to take effect on November 12, 2026, and a federal funding bill signed in September pushed that date to December 11, 2026. Many full-spectrum CBD products could be affected, and the industry is watching closely for further action from Congress.
